1. Introduction
These General Terms and Conditions for Contracting the Date a Home Portal ("TERMS") govern the relationship between you, a User of the DATE A HOME PLATFORM, and DATE A HOME PORTAL IMOBILIÁRIO DIGITAL LTDA, a limited liability company, registered under CNPJ/MF No. 48.339.738/0001-04, headquartered at Rua do Passeio, 38, Sala 215, Centro, CEP: 20.021-290, Rio de Janeiro, RJ ("DATE A HOME").
The engagement of services offered by DATE A HOME is a service aimed at users who wish to advertise, promote, and publicize high-end and luxury properties through the DATE A HOME PLATFORM. The use of the SERVICES is subject to these TERMS, as well as the Privacy Policy and other documents that govern the relationship between the User and DATE A HOME, including any future published document that may become part of this contractual relationship.
By electronically accepting these TERMS and/or engaging any service offered on the PLATFORM, you declare that you have read, understood, and agree to all conditions established herein. If you do not agree, you will not be able to use DATE A HOME's SERVICES. The engagement of any plan, service package, or promotion offered by DATE A HOME implies full acceptance of these TERMS at the time of payment, binding the User to the conditions set forth herein.
1.1. Supplementary Terms
These Terms supplement the General Terms and Conditions of Use and Engagement of the Platform, previously entered into between you, the user, and Date a Home.
1.2. Innovative Models
The Platform uses innovative models, such as 3Win Advertising and PRISM, to offer a unique experience in the luxury real estate market. 3Win Advertising creates a synergy between real estate agencies, luxury brands, and consumers, while PRISM enables personalized website replication for real estate agents, expanding brand exposure.
1.3. Acceptance of Terms
By using the Platform, you expressly agree to these Terms, the Privacy Policy, and all supplementary documents published for the management of the contractual relationship.
1.4. Non-Agreement
If you do not agree to these Terms, you will not be able to use the services offered by the Platform.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- Platform: The Date a Home website or application, whose domain is www.dateahome.com.br and www.dateahome.pt
- Applicant: An individual who engages the Platform's services to advertise properties they own.
- User: Any person who accesses the Platform, whether an Applicant or a visitor.
- 3Win Advertising: An advertising model that integrates real estate agencies, luxury brands, and consumers, transforming advertising costs into revenue.
- PRISM: A personalized replication strategy that enables real estate agents to have websites aligned with the company's brand, expanding exposure and engagement.
- Channels: Communication tools made available by the Platform, such as chats and forums, for interaction among Users.
- Registration Form: A form completed by the Applicant to engage the services.
- Cancellation: A button for the Applicant to cancel an engaged service.
3. Scope of Service
3.1. The Platform offers property listing advertisement services, enabling Applicants to connect with potential buyers or tenants.
3.2. The content of the listings is the sole responsibility of the Applicant, who is responsible for ensuring the accuracy and truthfulness of the published information.
3.3. Date a Home is not responsible for transactions or negotiations conducted between Applicants and Users, acting solely as an intermediary.
3.4. The Platform may contain links to third-party websites. Date a Home does not endorse or take responsibility for the content of such websites.
3.5. The Platform may use the 3Win Advertising model, in which luxury brands sponsor property listings, generating reimbursements for real estate agencies and agents and for the platform itself, as well as "backlinks" and interactions.
3.6. The Platform may also use the PRISM model, enabling real estate agents to have personalized websites aligned with the company's brand, expanding exposure and engagement.
4. Use of the Platform and Service Engagement
4.1. To use the Platform, the Applicant must create an account, providing accurate and up-to-date information.
4.2. Date a Home reserves the right to suspend or cancel accounts that violate these Terms or are used fraudulently.
4.3. The Applicant is responsible for maintaining the confidentiality of their password and for all activities carried out through their account.
4.4. Date a Home may amend these Terms at any time, communicating the changes with a minimum advance notice of 30 days. Continued use of the Platform after the changes implies acceptance of the new terms.
5. Payment, Cancellation, and Renewal
5.1. Basic use of the Platform is free of charge, but listing services, promotions, training, workshops, or other services may be subject to fees.
5.2. Payments must be made through the methods available on the Platform, such as credit card.
5.3. The Applicant may cancel the service at any time by submitting a formal request through the Cancellation Form.
5.4. In the event of cancellation, services will remain active until the end of the contracted period, with no right to a refund.
5.5. Date a Home may terminate the contract without cause, with 30 days' prior notice, returning any prepaid amounts on a pro-rata basis.
6. Responsibilities
6.1. Of the Applicant
The Applicant declares and warrants that:
- Accuracy of Information: All information provided on the Platform, including property data, prices, and conditions, is true, accurate, and up to date. The Applicant is solely responsible for any errors or omissions.
- Proper Use of the Platform: The Applicant will not use the Platform for illegal, fraudulent purposes or purposes that violate the rights of third parties. This includes the prohibition of publishing offensive, discriminatory content or content that infringes copyrights.
- Legitimacy: The Applicant has the legal authority to advertise the property, either as the owner or with the express authorization of the owner.
- Data Updates: The Applicant must keep their registration and payment data up to date. Issues arising from outdated information are the sole responsibility of the Applicant.
- Indemnification: The Applicant shall indemnify Date a Home for any damages, losses, or claims arising from the breach of these Terms or improper use of the Platform.
6.2. Of Date a Home
Date a Home commits to:
- Platform Maintenance: Maintaining the Platform in proper working order, except in cases of force majeure, technical failures, or scheduled maintenance.
- Data Privacy: Respecting user privacy, processing personal data in accordance with the LGPD (Brazilian General Data Protection Law) and the Privacy Policy.
- Transparency: Informing users about changes to the Terms, fees, or functionalities of the Platform, with a minimum advance notice of 30 days.
- Non-Interference: Not being held responsible for transactions or negotiations conducted between Applicants and Users, acting solely as an intermediary.
7. Limitation of Liability
7.1. Date a Home shall not be liable for:
- Direct or Indirect Damages: Losses arising from the use or inability to use the Platform, including lost profits, data loss, or business interruption.
- Third-Party Content: Inaccurate or unlawful information published by Applicants or Users on the Platform.
- Technical Failures: Issues arising from server failures, internet service providers, or other factors beyond the control of Date a Home.
- Transactions: Negotiations conducted between Applicants and Users, including breach of contracts or payments.
7.2. The Platform is provided "as is," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement of rights.
8. Intellectual Property
8.1. Rights of Date a Home
- All content on the Platform, including texts, images, logos, software, and functionalities, is protected by copyright and intellectual property rights of Date a Home.
- Unauthorized use of the Platform's content for commercial purposes or that infringes copyrights is expressly prohibited.
8.2. Rights of the Applicant
The Applicant retains the rights to the images and property information published on the Platform. However, by using the Platform, the Applicant authorizes Date a Home to replicate the content on other partner platforms, provided this does not entail additional costs.
8.3. Use of Data for Service Improvement
Date a Home may use aggregated and anonymous data from listings to improve the Platform, develop insights about the real estate market, and share information with partners, always respecting user privacy.
9. Privacy and Data Protection
9.1. Processing of Personal Data
- Date a Home processes users' personal data in accordance with the LGPD (Brazilian General Data Protection Law) and its Privacy Policy.
- The data collected includes registration information, payment details, and Platform usage data, used to provide, improve, and personalize services.
9.2. Data Sharing
- Date a Home may share data with partners and affiliated platforms to increase the visibility of listings, provided this does not entail additional costs to the Applicant.
- In cases of judicial requests or competent authority orders, Date a Home may disclose personal data as required by law.
9.3. User Rights
Users have the right to access, correct, delete, or limit the use of their personal data, as provided under the LGPD. To exercise these rights, the user should contact us via email: suporte@dateahome.com.br
10. Use of Artificial Intelligence (A.I.)
10.1. A.I. Functionalities on the Platform
Date a Home uses Artificial Intelligence (A.I.) technologies to enhance the user experience and optimize the services offered. This includes, but is not limited to:
- Personalized Recommendations: Use of A.I. algorithms to suggest properties based on the user's profile and search history.
- Analytics Tools: Use of A.I. to provide insights about the real estate market, such as pricing trends and demand.
- Chatbots and Automated Support: Implementation of virtual assistants to answer frequently asked questions and assist users.
- Content Moderation: Use of A.I. to identify and remove inappropriate, fraudulent content or content that violates these Terms.
10.2. Transparency and Control
10.2.1. Date a Home commits to being transparent about the use of A.I. on the Platform, informing users about which functionalities are powered by A.I. and how they impact their experience.
10.2.2. Users have the right to opt out of certain A.I. functionalities, where applicable, through their account settings.
10.3. Responsibility for A.I. Decisions
10.3.1. Date a Home is responsible for the development, implementation, and monitoring of A.I. systems used on the Platform.
10.3.2. Decisions made based on A.I., such as property recommendations or market analyses, are automated suggestions and do not replace human evaluation or the user's responsibility.
10.3.3. Date a Home is not responsible for decisions made by users based on information generated by A.I.; it is the user's responsibility to critically evaluate such information.
10.4. Data Protection and A.I.
10.4.1. The data used to train and operate A.I. systems is processed in accordance with the LGPD (Brazilian General Data Protection Law) and Date a Home's Privacy Policy.
10.4.2. Date a Home does not use sensitive personal data (such as race, religion, or sexual orientation) to train A.I. algorithms, unless expressly authorized by the user and in compliance with applicable legislation.
10.5. Continuous Improvements
10.5.1. Date a Home commits to continuously monitoring and improving its A.I. systems, aiming to reduce biases, increase accuracy, and ensure algorithmic fairness.
10.5.2. Users may report issues or suggest improvements related to the use of A.I. through the Platform's support channel.
11. Authentication via Third-Party Services (Google)
11.1. Sign in with Google
The Platform offers the option to register and sign in using the User's Google account, through the OAuth 2.0 protocol provided by Google. By choosing this authentication method, the User authorizes Date a Home to access certain information from their Google profile.
11.2. Data Collected from Google
When using Google sign-in, Date a Home exclusively accesses the following information from the User's profile:
- Full name: used to identify the User on the Platform and to pre-fill the registration form.
- Email address: used as the unique account identifier and for service-related communications.
- Profile photo: used as the User's avatar image on the Platform, when available.
11.3. Use and Storage of Data
11.3.1. Data obtained via Google is used exclusively to create or link the User's account on the Platform, personalize the user experience, and streamline the registration process.
11.3.2. Date a Home does not access, store, or use the User's Google account password. Authentication is performed entirely by Google's servers.
11.3.3. Date a Home does not request or access contacts, calendars, Google Drive files, or any other data beyond those mentioned in clause 11.2.
11.3.4. Collected data is stored securely and handled in accordance with Date a Home's Privacy Policy and applicable data protection legislation.
11.4. Revoking Access
11.4.1. The User may revoke Date a Home's access to their Google account at any time through their Google account security settings (https://myaccount.google.com/permissions).
11.4.2. Revoking Google access does not automatically delete the User's account on the Platform. To request complete data deletion, the User must follow the procedure described in the Privacy Policy.
11.4.3. The User may also request the deletion of their account and all associated data by contacting suporte@dateahome.com.br.
11.5. Liability
11.5.1. Date a Home is not responsible for the availability, security, or operation of Google's authentication services.
11.5.2. The use of Google sign-in is also subject to Google's Terms of Service and Privacy Policy.
11.5.3. By using Google sign-in, the User acknowledges and agrees to the sharing of data described in clause 11.2 with Date a Home.
